General Conditions of Sale (GCS)

1. Purpose

The purpose of these General Terms and Conditions of Sale (GTC) is to define the terms and conditions for making available the personal and collective thinking game application (hereinafter "the Application") and the conditions of use by the user (hereinafter "the User"). The Application is published by DeifiedYourMind, whose head office is located at [Company address].

2. Acceptance of the T&Cs

Access to and use of the Application are subject to full acceptance of these General Terms and Conditions. The User acknowledges having read the General Terms and Conditions and declares that they accept them without reservation.

3. Services Offered

The Application offers three access plans:

• Free Account: Access to a sample of 10 questions.
• Paid Account: Access to 20 new questions per month, automatically renewable.
• Annual One-Shot: Access to 240 exclusive questions, available immediately for a full year.

The services provided include the ability to answer questions, save your answers, view your previous answers to track your personal progress, and participate in group sessions to discover your friends' answers.

4. Subscriptions and Payments

• Paid Account: The monthly subscription is payable in advance via [payment method]. Renewal is automatic each month, unless terminated by the User before the renewal date.
• Annual One-Shot: Payment is made once for one year of access. No automatic renewal is provided.

Prices are listed in [currency] and include all applicable taxes. DeifiedYourMind reserves the right to change prices at any time, but changes will not apply to current subscriptions.

5. Termination and Right of Withdrawal

The User may terminate his/her subscription at any time via the Application interface. The termination will take effect at the end of the current billing period.

In accordance with Article L121-21 of the Consumer Code, the User has a right of withdrawal of 14 days from the subscription of the subscription, unless the User has started to use the services of the Application. In this case, no refund will be possible.

6. Confidentiality and Data Protection

The information and responses recorded by the User are strictly confidential. DeifiedYourMind undertakes not to disclose this information to third parties, except in the event of a legal request or for technical reasons necessary for the proper functioning of the Application.

In accordance with the Data Protection Act of 6 January 1978 as amended and the General Data Protection Regulation (GDPR), the User has the right to access, rectify and delete personal data concerning him/her.

7. Intellectual Property

All elements of the Application, including questions, graphics, logos, and texts, are the exclusive property of DeifiedYourMind. Any total or partial reproduction or representation of these elements without prior authorization is prohibited.

8. Limitation of Liability

DeifiedYourMind cannot be held responsible for any direct or indirect damage resulting from the use of the Application, including loss of data or interruptions of service.

9. Modifications to the T&Cs

DeifiedYourMind reserves the right to modify these T&Cs at any time. The modifications will be applicable as soon as they are posted online on the Application. The User is invited to regularly consult the T&Cs to keep informed of any possible modifications.

10. Applicable Law and Competent Jurisdiction

These General Terms and Conditions are subject to French law. Any dispute relating to the interpretation or execution of these General Terms and Conditions shall be under the exclusive jurisdiction of the courts within the jurisdiction of the registered office of DeifiedYourMind.
